Website and Diner Terms

These are proposed public terms for a future U.S. Dohos service. They are not current terms, do not bind any person, do not authorize a launch, and do not describe an activated service. The future Dohos legal entity, contact details, effective date, supported Restaurants, jurisdictions, capabilities, payment configuration, dispute terms, and assent mechanism have not been approved. This draft must not be published or presented for acceptance until every activation condition in its governance review is satisfied.

01Read these terms before using the service

These Website and Diner Terms govern a person's authorized use of the Dohos-operated website and the parts of the Dohos Service made available directly to Restaurant customers, including an approved web, voice, or messaging ordering experience that links or refers to these Terms.

By taking the affirmative action identified in an activated acceptance flow, you agree to the version of these Terms presented to you. Merely visiting a page, hearing a notice, remaining on a call, receiving a message, or failing to object will not be treated as agreement when applicable law or the activated flow requires an affirmative act.

If you do not agree, do not take the acceptance action or submit an Order Request through the Dohos Service. You may contact the Restaurant through another available channel.

The activated version of these Terms will identify:

  • the legal entity that operates Dohos
  • the effective date and version
  • a postal address and monitored support contact
  • the geographic scope
  • the precise service and acceptance action covered
  • any jurisdiction-specific terms
NOTEThose facts are not approved in this draft, so these Terms cannot yet be activated.

02Key roles

In these Terms:

  • Dohos means the legal entity identified in the activated version as the provider of the applicable software, AI-assisted interaction, communications routing, and related support functions.
  • Restaurant means the independently owned food-service business and location identified during an interaction as the seller of Restaurant Products.
  • Diner means a person who browses, asks about, requests, pays for, receives, or is identified with an order from a Restaurant.
  • Payer means the person or organization that lawfully authorizes the payment method used for a Restaurant Transaction.
  • Restaurant Products means the food, beverages, merchandise, or other items that the Restaurant lawfully offers through an activated channel.
  • Order Request means the items and instructions submitted to a Restaurant for possible acceptance.
  • Accepted Order means an Order Request that the Restaurant accepts through the approved acceptance mechanism.
  • Restaurant Transaction means the proposed or completed sale of Restaurant Products by the Restaurant to the Diner.
  • Dohos Service means only the release-specific capabilities expressly activated for the relevant Restaurant, location, channel, and jurisdiction.
  • Provider means a third party that supplies an approved technical, payment, communications, hosting, or other service.

The Restaurant is the target seller and fulfillment principal for Restaurant Products. Dohos supplies the limited technology service described in the activated flow. Dohos is not the Restaurant, food preparer, delivery provider, bank, emergency service, healthcare provider, or universal source of Restaurant information.

Labels do not control over actual conduct or law. If the activated product, payment arrangement, or conduct does not match these role statements, Dohos must stop the affected capability and correct the terms rather than rely on the label.

03Scope and other terms

These Terms apply only to the Dohos-operated surface and transaction functions expressly identified at the point of use. They do not govern:

  • a Restaurant's independent website, app, premises, personnel, loyalty program, marketing, delivery, or other business practice
  • the Restaurant's preparation, packaging, substitution, pickup, delivery, refund decision, or food-safety practice
  • a Provider's independent service or legal terms
  • a Restaurant's sale except for the limited Dohos-facing rules expressly stated here
  • a disabled, demonstration, preview, experimental, future, or unsupported capability

The following documents may also apply when properly presented:

A public notice is not consent to every practice and does not become a contract merely because it is linked. If documents conflict, mandatory law and the transaction-specific disclosure presented before confirmation control, followed by these Terms for the limited Dohos Service. A Restaurant policy cannot expand Dohos's rights, and these Terms cannot eliminate duties the Restaurant owes independently.

04Eligibility and authority

You may use the covered service only if:

  • you can form a binding agreement under applicable law
  • your use is lawful in the place where you use it
  • you have authority to provide any information, instructions, or payment method you submit
  • you comply with age restrictions for any Restaurant Product

The activated service is not designed as a child-directed service. A parent or legal guardian must use an approved adult-assisted path where a person cannot legally agree or authorize a purchase.

If you act for another person, business, or organization, you represent only that you have the authority actually required for that action. A phone number, device, email address, payment credential, account login, or delivery address does not by itself prove identity or authority.

Dohos or a Restaurant may request reasonable verification before processing a sensitive request, refund, account action, or transaction. Verification must be proportionate and must not be used to obstruct a lawful right.

05Accounts and access

Most Diner interactions should not require a persistent Dohos consumer account unless the activated design and law justify one. If an activated feature permits or requires an account, you agree to:

  • provide accurate information that you are authorized to provide
  • protect authentication credentials and recovery methods
  • use only your own account or an account you are authorized to use
  • promptly report suspected unauthorized access
  • keep material contact information reasonably current

Dohos may apply proportionate rate limits, authentication checks, or temporary access controls to protect the service, Restaurants, Diners, and Providers. Dohos will not use security language as a pretext to block lawful cancellation, refund, privacy, accessibility, or dispute routes.

You remain responsible for actions you knowingly authorize. You are not automatically responsible for unauthorized activity merely because it involved your device, number, email, or payment method.

06Restaurant information and menu content

The Restaurant supplies or approves its menu, ingredients, allergen and dietary information, prices, taxes, fees, discounts, availability, hours, location details, fulfillment options, timing estimates, and transaction policies.

Dohos may format, read, route, or summarize approved Restaurant information. Dohos does not independently prepare food or verify every Restaurant statement. The activated service must preserve the Restaurant source and version used for an interaction.

Restaurant information may change. The version presented during final order review, together with any correction accepted before submission, governs the Order Request. A general website page, search result, prior interaction, or AI-generated answer does not override the final reviewed transaction details.

If information appears inconsistent, incomplete, or implausible, do not rely on it. Ask for clarification or contact the Restaurant directly.

07AI-assisted and voice interactions

An activated channel may use automated speech recognition, language models, text-to-speech, rules, and other software to help receive, structure, and route an interaction. The service must identify its automated nature at the time and in the manner required by law and the approved notice — see the AI and Voice Transparency Notice for the full disclosure this Terms section only summarizes.

AI-assisted output can be incomplete, delayed, misunderstood, or wrong. It may not infer or invent:

  • ingredients, allergens, dietary suitability, cross-contact controls, or medical safety
  • current price, tax, fee, availability, hours, or timing without approved Restaurant data
  • Restaurant acceptance, fulfillment, refund approval, or delivery status without evidence
  • legal, medical, nutritional, tax, financial, or emergency advice
  • a person's identity, age, authority, consent, intent, or final confirmation from silence or ambiguous speech

The service must provide a reasonable correction, repeat, human-assistance, alternative-channel, or exit route appropriate to the context. If the system cannot reliably complete a material step, it should stop, ask for clarification, route to the approved fallback, or decline the step.

Use of an AI-assisted channel does not authorize recording, transcription, biometric processing, training, or marketing. Any such practice requires a separately approved capability, legal basis, notice or consent where required, and release-specific evidence.

08Allergens, dietary needs, and food safety

Do not use the Dohos Service as the sole source for a serious allergy, dietary, medical, or food-safety decision. Restaurant recipes, ingredients, suppliers, preparation areas, substitutions, and cross-contact conditions can change and are controlled by the Restaurant.

If you communicate an allergy or dietary instruction:

  • provide it clearly during the approved step
  • review the exact instruction during final confirmation
  • do not assume an item is safe because an AI system, menu label, or prior order used a particular word
  • contact the Restaurant directly if the Restaurant has not affirmatively confirmed the information needed for your decision

Dohos must not convert a preference into an allergy statement, silently remove an instruction, promise an allergen-free result, or represent that a Restaurant can accommodate a request without Restaurant-confirmed information.

NOTEFor a medical emergency, contact the appropriate emergency service. Dohos is not an emergency response service and should not delay emergency assistance.

09Creating an Order Request

The service should let you add, remove, and correct items and material instructions before submission. Before the final submission action, it must present or read back, in an accessible and understandable manner:

  • the Restaurant and location
  • items, quantities, options, and material instructions
  • fulfillment method and destination or pickup location, as applicable
  • current price components, discounts, taxes, mandatory fees, delivery charges, tip, and total
  • material timing and availability information
  • the applicable cancellation, refund, substitution, and fulfillment terms
  • the action that will submit the Order Request and, if applicable, authorize payment

You are responsible for reviewing this information and using the available correction path. A request for information, addition of an item, conversational acknowledgment, silence, background speech, or failure to interrupt is not final confirmation.

Submitting an Order Request asks the Restaurant to consider it. It does not by itself mean that the Restaurant has accepted the order, begun preparation, or promised fulfillment.

10Restaurant acceptance and fulfillment

The Restaurant decides whether to accept or reject an Order Request. The activated service must communicate the acceptance status and preserve the relevant evidence.

An automated acknowledgment that the system received information is not Restaurant acceptance unless the message clearly says that the Restaurant accepted the exact reviewed order through the approved mechanism.

The Restaurant is responsible for preparation, packaging, substitution, pickup, delivery it controls, and lawful sale of Restaurant Products. Timing is an estimate unless the Restaurant clearly commits otherwise. Weather, traffic, demand, staffing, inventory, technical outages, and safety conditions may affect fulfillment.

Material substitutions require the Diner's approval where law, safety, the Restaurant policy, or the activated flow requires it. Dohos must not authorize a substitution merely because it appears similar.

11Prices, taxes, fees, and tips

The activated confirmation flow must display or read the current transaction components before submission. It must not hide a mandatory charge, mislabel a Dohos fee as a Restaurant charge, describe a mandatory fee as a tip, or make a preselected optional amount appear required.

The Restaurant is responsible for Restaurant item prices and the tax treatment assigned to the Restaurant Transaction, subject to Dohos's direct duties for any amount it separately imposes or represents. A Provider may calculate or process amounts, but Provider involvement does not cure an inaccurate presentation.

A tip must be voluntary, clearly labeled, and presented with a practical way to select another amount or no tip where legally permitted. The activated flow must disclose the intended recipient and treatment of the tip accurately.

If a displayed amount conflicts with the final confirmation, the discrepancy must be resolved before submission. Post-submission price changes require a lawful, disclosed, and authorized process.

12Payment authorization

Payment functions apply only when an approved Payment Provider and Restaurant payment configuration are active. Under the target launch model:

  • the Restaurant is the seller and target merchant for the Restaurant Transaction
  • payment credentials are entered or captured only through the approved Payment Provider path
  • Dohos does not store or request a full card number, security code, bank credential, wallet secret, or other prohibited payment credential in ordinary product, support, audio, transcript, analytics, or log fields
  • any Dohos fee is separately authorized, accurately described, and accounted for

By taking the clearly labeled payment action, the Payer authorizes the disclosed amount and payment purpose through the identified Payment Provider. This authorization is limited to that transaction or to a separately disclosed recurring arrangement. It does not authorize unrelated charges, marketing, recording, or future use of payment information.

Payment authorization does not guarantee Restaurant acceptance. If the flow uses a hold, delayed capture, reversal, partial capture, refund, or other payment state, the service must disclose the material effect and communicate the outcome accurately.

Do not provide payment credentials in free-form messages, support tickets, order notes, or spoken content unless the activated secure Provider path expressly requests them. See how Dohos handles cash and card for how this boundary is enforced end to end.

13Cancellations, refunds, and disputes

The Restaurant's disclosed policy and applicable law govern cancellation, replacement, and refund decisions for Restaurant Products. Dohos may provide the technical route, evidence, and support, but it does not promise that the Restaurant will approve a request.

The activated service must explain:

  • how and when to request cancellation or correction
  • whether preparation or fulfillment has begun
  • which party decides the request
  • expected communication and payment-processing timing
  • how to escalate a suspected unauthorized charge, duplicate charge, missing item, quality issue, or service failure

Nothing in these Terms limits a non-waivable payment, card-network, consumer, food-safety, privacy, accessibility, or other legal right. A person does not need to waive rights, remove an honest review, accept marketing, or provide irrelevant data to seek support or a lawful remedy.

Contacting the Restaurant or Dohos does not prevent a Payer from using an available Provider or legal dispute route. Repeated recovery for the same loss is not permitted.

14Communications

Dohos or the Restaurant may send transaction communications that are reasonably necessary to complete or report a requested interaction, such as verification, order confirmation, status, pickup, delivery, security, support, cancellation, or refund messages.

Transaction communications do not create consent to marketing. Promotional calls, texts, or emails require the separate consent or other lawful basis applicable to the exact sender, brand, channel, purpose, and program.

Message and data rates may apply according to your carrier plan. Delivery is not guaranteed because carriers, devices, Providers, and network conditions are outside complete Dohos control.

An activated SMS program must provide the disclosed STOP and HELP process and honor legally sufficient revocation through supported reasonable methods. Opting out of marketing should not block a necessary one-time security or transaction message where law permits it, but programs and purposes must not be collapsed to evade a withdrawal. 15Privacy

The activated Dohos Privacy Notice explains the Personal Data Dohos processes for its described roles and purposes. The Restaurant may separately control Personal Data for its customer relationship, sale, fulfillment, loyalty, marketing, legal, and operational purposes.

These Terms do not provide consent to processing that requires a separate notice, choice, authorization, or consent. Dohos must minimize collection and must not treat use of the service as permission to sell Personal Data, use it for targeted advertising, create a Voiceprint, train a general model on Restaurant or Diner content, or retain raw recordings or transcripts unless a separately approved program lawfully permits and discloses that practice.

Do not submit another person's sensitive information unless it is necessary for the requested transaction and you have authority to provide it.

16Acceptable use

You may use the service only for its intended lawful purpose. You must not knowingly:

  • access another person's account or transaction without authority
  • submit a payment method, contact detail, identity, instruction, or content you are not authorized to use
  • place fraudulent, abusive, deceptive, harassing, threatening, or unlawful requests
  • attempt to obtain age-restricted or otherwise restricted products contrary to law or Restaurant controls
  • interfere with service availability, security, access controls, rate limits, logs, evidence, or Provider systems
  • introduce malware, scrape protected data, probe for vulnerabilities without authorization, or automate abusive traffic
  • use output to impersonate a person or misrepresent Restaurant acceptance, food safety, payment, consent, or legal status
  • extract, reconstruct, or expose payment credentials, authentication secrets, Personal Data, model prompts, or security controls
  • use the service to violate another person's privacy, publicity, intellectual-property, contractual, or other rights

Good-faith security research must use the published security-reporting route and any applicable safe-harbor terms — see how to report a vulnerability. The absence of a published route does not authorize testing against production. The full conduct policy for Restaurant users and integration partners is the Acceptable Use Policy; this section covers only the Diner-facing subset.

17User-provided content and instructions

You retain rights you lawfully hold in content you provide. You give Dohos a limited, nonexclusive permission to host, process, transmit, format, and disclose that content only as reasonably necessary to provide, secure, support, and evidence the requested service and to meet legal duties.

This permission does not transfer ownership, authorize sale or targeted advertising, or grant an unrestricted model-training right. It ends when the purpose and lawful retention period end, subject to required records, security, disputes, and legal holds.

You represent that you have the rights and authority needed for the content and instructions you knowingly submit. This representation does not shift to you responsibility for content that Dohos or a Provider independently creates, changes, infers, or exposes.

Dohos may remove or restrict content when reasonably necessary to address illegality, infringement, security, privacy, safety, or contract violations. It should preserve and provide process appropriate to the seriousness and context.

18Dohos materials and permitted use

The Dohos Service, excluding Restaurant Content and user-provided content, may contain software, interface designs, text, graphics, documentation, trademarks, and other materials owned by Dohos or its licensors.

Subject to these Terms, Dohos grants you a limited, revocable, nonexclusive, nontransferable right to use the activated public service for its intended personal transaction or evaluation purpose. You may not sell, sublicense, copy in bulk, reverse engineer except where a restriction is prohibited by law, remove notices, or use Dohos branding in a way that suggests sponsorship or endorsement.

Restaurant names, menus, marks, and content belong to the Restaurant or its licensors. No license to use them outside the relevant interaction is granted.

19Feedback

If you voluntarily provide product feedback, Dohos may use the ideas to evaluate and improve the service without an obligation to pay you, provided that Dohos does not claim ownership of your preexisting materials, disclose confidential information contrary to a duty, or use Personal Data outside the approved notice and law.

Do not include payment credentials, medical details, trade secrets, or another person's Personal Data in general feedback.

Nothing in these Terms prohibits an honest review, lawful report to a regulator, protected whistleblowing, participation in an investigation, or disclosure that cannot lawfully be restricted.

21Service changes and availability

Dohos may maintain, correct, secure, or change the service. It must not use this clause to impose a new fee, expand data use, weaken a material promise, alter a confirmed Restaurant Transaction, or add a binding dispute term without the notice and assent required by law and the activated agreement.

The service can be unavailable, delayed, or degraded. The activated design must provide a practical Restaurant or support alternative for material failures where reasonably available. Dohos does not promise universal coverage, uninterrupted availability, perfect accuracy, or compatibility with every device, language, assistive technology, Restaurant, or location.

22Suspension and termination

Dohos may proportionately restrict or suspend access when reasonably necessary to address:

  • fraud, abuse, illegality, or a credible safety risk
  • unauthorized account or payment activity
  • security or privacy risk
  • material interference with the service or another person
  • a material violation of these Terms

Where appropriate, Dohos should provide notice, reasons, a correction or appeal route, and restoration after the issue is resolved. Immediate action may be necessary for an urgent threat or legal obligation.

Suspension does not cancel an Accepted Order, payment, refund, privacy request, legal hold, or other obligation unless the applicable process lawfully does so. Sections that by their nature address prior transactions, rights, evidence, intellectual property, disputes, disclaimers, limitations, and lawful retention may survive.

23Disclaimers

To the maximum extent permitted by applicable law, the Dohos Service is provided on an "as available" basis. Dohos does not warrant that it will be uninterrupted, error-free, universally secure, available in every location, or accurate for information controlled by a Restaurant or another third party.

Dohos does not warrant that AI-assisted output is human-generated, complete, or suitable for allergy, medical, legal, tax, financial, safety-critical, or emergency decisions. Restaurant Products, Restaurant Content, fulfillment, and Restaurant-controlled conduct remain the Restaurant's responsibility under the target role model.

These disclaimers do not exclude an express commitment in an activated transaction disclosure, liability that cannot lawfully be disclaimed, or responsibility for Dohos's own statements, configuration, negligence, statutory duties, or misconduct.

Some jurisdictions do not permit particular disclaimers, so they apply only to the extent lawful.

24Limits of liability

Any activated limitation must be conspicuous, fair, jurisdictionally valid, coordinated with the Restaurant contract and insurance, and presented through valid assent.

PLACEHOLDER — The monetary liability cap. None is proposed in this draft because the Dohos entity, economics, insurance, audience, jurisdiction, and risk allocation are unverified.

The activated terms may distinguish direct damages from excluded categories only to the extent permitted by law. They must not purport to limit:

  • liability that law makes non-waivable
  • fraud, willful misconduct, or other conduct that cannot lawfully be limited
  • unauthorized charges or statutory remedies that cannot be waived
  • rights under applicable privacy, communications, consumer, accessibility, food-safety, or payment law
  • obligations expressly preserved in a transaction-specific disclosure
NOTEThe absence of an approved cap is a hard activation block, not a statement that current liability is unlimited or limited in any particular way.

25Indemnity

PLACEHOLDER — The consumer indemnity clause, if any. None is proposed for activation without counsel's jurisdiction-specific approval.

Any future clause must be narrow, understandable, and limited to loss caused by a person's knowing unlawful conduct, material breach, or rights violation. It must not require a Diner to indemnify Dohos for Dohos's own conduct, a Restaurant's independent conduct, a Provider failure allocated to Dohos, or a non-waivable duty.

NOTEThe absence of an approved clause is a hard activation block if counsel determines one is necessary; it is not permission to import the broader Restaurant commercial indemnity.

26Disputes, governing law, and venue

Try first to use the Restaurant or Dohos support route identified for the transaction so the relevant party can investigate and preserve evidence. Informal contact is optional where law preserves an immediate regulator, Provider, court, emergency, or other route.

PLACEHOLDER — The governing-law and forum provision. It must match the formed Dohos entity, actual operations, target jurisdictions, and consumer-law limits, and must preserve non-waivable local rights and available small-claims or agency processes as required.
NOTEThis draft does not require arbitration, waive a jury trial, waive class or representative relief, shorten a limitations period, or select a law or forum. Those are unapproved executive and counsel decisions that require a documented enforceability, fairness, cost, accessibility, and operational review plus valid assent. No such term may be added through a silent website edit.

27Changes to these Terms

Dohos may update these Terms prospectively only through the approved document-control process. The activated process must:

  • assign a version and effective date
  • preserve prior versions and the exact rendered text
  • identify material changes in understandable language
  • provide advance notice when required or promised
  • obtain renewed affirmative assent when law or the nature of the change requires it
  • preserve a durable copy
  • link the accepted version to the relevant person, Restaurant, transaction, release, and evidence

Continued use alone will not be assumed to accept every material change. A new version does not retroactively change an earlier Restaurant Transaction or cure prior conduct. Superseded versions, once any exist, will be preserved at the version archive.

28Electronic communications and records

Where you affirmatively agree to electronic records, Dohos may provide the covered notices and records electronically using the disclosed method. The consent flow must identify hardware/software requirements, how to obtain a paper copy, whether a fee applies, how to update contact details, and how to withdraw consent without losing rights where required by law.

Dohos must preserve the version presented, the affirmative action, date/time, identity or session evidence, authority context, delivery, and a durable copy. Acceptance of these Terms is separate from payment authorization, Restaurant acceptance, marketing consent, recording consent, privacy choice, and biometric authorization.

29Accessibility and language

Dohos aims to make the covered service and legal information usable by people with disabilities. The activated service must provide the approved accessibility contact and a practical assistance route — see the Accessibility Statement.

If you cannot access a disclosure, confirmation, cancellation, privacy request, payment, support, or dispute step, request an alternative format or method. Asking for assistance will not reduce your rights or change the price of a Restaurant Product except where a lawful, independently applicable charge is clearly disclosed.

A translation may be provided for convenience or as required. The activated terms must identify which language controls in a way that is lawful and not misleading, and the acceptance experience must support meaningful understanding. This draft makes no WCAG, ADA, certification, universal-access, or language-coverage claim.

30General terms

If a provision is unenforceable, it should be enforced to the maximum lawful extent or severed only as applicable law permits, without rewriting a material bargain in a way a person could not reasonably anticipate.

Dohos's failure to enforce a provision once is not an automatic waiver. A waiver must be authorized and applies only to its stated scope.

You may not assign a consumer account or personal acceptance without Dohos's consent, except where law permits. Dohos may not assign these Terms in a manner that materially reduces rights or expands data use without required notice, consent, or assent.

These Terms, the transaction-specific disclosures, and properly incorporated public documents are the proposed entire agreement between Dohos and the accepting person for the narrow Dohos Service covered. They do not replace a Restaurant's transaction duties or create rights for unrelated parties except where law or an express provision provides otherwise.

Headings aid reading and do not change meaning. "Including" means including without limitation. The singular may include the plural where context requires. Mandatory law controls over a conflicting term.

31Contact and notices

The activated version will provide monitored support, legal-notice, privacy, accessibility, and security routes appropriate to the issue, plus the Dohos legal entity and postal address. It will distinguish a Restaurant issue from a Dohos issue and explain how misdirected requests are routed.
